What Texas Laws Can Affect My Claim?

The “51% Bar” Rule

Texas follows a “proportionate responsibility” model. This is often called the 51% bar rule. According to Texas Civil Practice and Remedies Code § 33.001, you can only recover damages if you are not more than 50% responsible for the crash.

If a jury finds you were 51% or more at fault, you get nothing. If you were less than 50% at fault, your compensation is reduced by your percentage of fault. For example, if you have $100,000 in damages but are found 20% at fault, you would receive $80,000. Insurance adjusters often try to shift blame to the rider to use this law against you. Motorcycle Helmet Laws

Texas law regarding helmets is specific. Texas Transportation Code § 661.003 states that all riders and passengers must wear a helmet (Source).

There is an exception. You may ride without a helmet if you are at least 21 years old and have either:

  1. Successfully completed a motorcycle operator training and safety course, or
  2. Health insurance coverage that provides medical benefits for crash injuries.

Even if you were legally not wearing a helmet, the defense might argue that your choice contributed to your injuries. This does not automatically bar you from recovery, but it can complicate the argument over damages.

Minimum Insurance Requirements

Drivers in Texas must carry liability insurance.

Texas Transportation Code § 601.072 sets the minimum coverage amounts:

  • $30,000 for bodily injury to one person
  • $60,000 for bodily injury to two or more persons per accident
  • $25,000 for property damage
